Terms & Conditions

All prices F.O.B. Tupelo, MS

Terms:  Net 30 for qualified customers.  A 50% deposit may be required with order if credit has not been established.  A 2% discount available for Cash before Shipping or Bank Letter of Credit.

Overdue Balances:  A monthly interest charge of 1 1/2% will be applied to all overdue balances.

FR  Foam:  Fire Rated foam is standard in all Tupelo Manufacturing Chairs.

Changes and Cancellations:  We gladly cooperate with customers, wherever possible, on amendments of style, quantity, finish or fabric in any order.  However, if production has progressed and fabric or frames are not recoverable for general use, we cannot honor such changes or cancellations.  Customers should accordingly consider our acceptance of any order as final and binding.

Damage in Transit:  We cannot be responsible for any transit damage.  Customers should immediately inspect all shipments for visible damage before signing the bill of lading.  A signed bill of lading indicates that the shipment arrived in good condition.  If concealed damage is discovered after opening the cartons, the customer should immediately file a concealed damage report with the carrier.  According to ICC regulations, this must be done within 15 days, or no claim is possible.  It is the customers responsibility to file a claim with the carrier, then re-order chairs or chair parts as needed for replacements.

Partial Shipments:  We will ship partial orders, as they are completed, by customer request only.  Full freight charges will apply and will generally be higher than for a complete shipment.

Coordinated Finishes:  In addition to our standard finishes, Tupelo Manufacturing can custom-finish your goods with a stain of your choice.  However, if a custom stain is intended to match existing goods, this must be explicitly stated in your purchase order.  In this case we may require a sample block or color chip from you, and we will send you a sample block for your approval before proceeding with your order.  Approval of the sample block constitutes acceptance of the matched stain, and the customer must be aware of the fact that slight variations in darkness, grain, and color are to be expected when finishing real wood products.  An up charge will apply to custom stains.

COM Yardage must be clearly marked with customer order number and item number. It is the customers responsibility to communicate any requirements on direction of fabric or other special instructions.

Engineering Changes:  At Tupelo Manufacturing we are constantly striving to improve the quality, cost, comfort, and appeal of our products.  As a result, we frequently make minor engineering changes in the designs of our models.  Most of these changes are a result of suggestions and comments from our customers, and we would appreciate your feedback as well.  All such improvements in our product will necessarily result in a minor change in dimensions, hardware, springs, foam, and / or visual accents.  Accordingly, if your application requires an exact match of a product you have previously purchased from us, please let us know at the time of your order, so that we can inform you of any changes we have subsequently introduced in the model.
